Higher education provider to correct notice
169-10(1)
If, after giving a person a notice under section 169-5 , a higher education provider is satisfied that a material particular in the notice was not, or has ceased to be, correct, the provider must give a further written notice to the person setting out the correct particular.
Person may request correction of notice
169-10(2)
A person who receives a notice from a higher education provider under section 169-5 may give to the provider a written request for the notice to be corrected in respect of a material particular if the person considers that the notice was not, or has ceased to be, correct in that particular.
169-10(3)
The request must be given to an *appropriate officer of the provider either: (a) within 14 days after the day the notice was given; or (b) within such further period as the provider allows for the giving of the request.
169-10(4)
The request must: (a) specify the particular in the notice that the person considers is incorrect; and (b) specify the reasons the person has for considering that the particular is incorrect.
169-10(5)
The making of the request does not affect any liability or entitlement of the person under this Act (including the person ' s *Student Learning Entitlement).
Higher education provider to process request
169-10(6)
If a higher education provider receives a request under this section the provider must, as soon as practicable: (a) determine the matter to which the request relates; and (b) notify the person in writing of the provider ' s determination; and (c) if the provider determines that a material particular in the notice was not, or has ceased to be, correct - give a further notice under subsection (1) .
