Explanatory Memorandum

Paragraph 4(5)(e) is the corollary of paragraph 4(5)(d) and functions on or after the day fixed by Proclamation. See item 10 for amendments to paragraph 4(5)(e).
Paragraph 4(5)(d) is the corollary of paragraph 4(5)(e) and functions until the day fixed by Proclamation. See item 9 for amendments to paragraph 4(5)(d).
That is, corresponding provisions in jurisdictions that have adopted the Model Uniform Evidence Bill as endorsed by the former Standing Committee of Attorneys-General.

This section will be removed from the Commonwealth Evidence Act upon the commencement of the Civil Law and Justice Legislation Amendment Act 2014 .
