69BA   Institution of offence proceedings no bar to winding up

The institution of proceedings against a body corporate for an offence against this Act, the Financial Sector (Collection of Data) Act 2001 or the Financial Accountability Regime Act 2023 does not prevent the institution of proceedings for the winding-up of the body corporate on a ground that relates to the matter that constitutes the offence.

S 69BA amended by No 68 of 2023, s 3 and Sch 1 item 30, by substituting " this Act, the Financial Sector (Collection of Data) Act 2001 or the Financial Accountability Regime Act 2023 " for " this Act or the Financial Sector (Collection of Data) Act 2001 " , effective 15 September 2023.
