SECTION 344   POWER TO OBTAIN INFORMATION FROM A PERSON WHO OWES A DEBT TO THE COMMONWEALTH  

344(1)   Information from persons owing debts under Parts of Act  

The Secretary may require a person who owes a debt to the Commonwealth under this Act in relation to a student assistance benefit:

(a) either to:

(i) give to the Department information that is relevant to the person ' s financial situation; or

(ii) produce to the Department a document that is relevant to the person ' s financial situation; and

(b) if the person ' s address changes - to notify the Department of the new address within 14 days of the change.

S 344(1) amended by No 26 of 2018, s 3 and Sch 17 items 68 and 69, by omitting " is in the person ' s custody or under the person ' s control and " after " a document that " from para (a)(ii) and repealing the note, applicable in relation to requirements made on or after 1 July 2018. The note formerly read:

A requirement under this subsection may be sent to a company as well as to a natural person - subsection 2C(1) of the Acts Interpretation Act 1901 provides that person includes a body corporate.

S 344(1) amended by No 46 of 2011, s 3 and Sch 2 item 1071, by substituting " subsection 2C(1) " for " paragraph 22(1)(a) " in the note at the end, effective 27 December 2011. For saving and transitional provisions see note under s 343(1) .

344(3)   Section 343 not affected  

This section does not limit section 343 .
