Meaning of given - sections 28A and 29 of the Acts Interpretation Act 1901 provides that a notice is given to a natural person if the notice is:

• delivered personally; or

• left at the last known address of the person; or

• sent by pre-paid post to the last known address of the person.

347(2) Contents of notice  

The notice must state:

(a) how the person is to give the information; and

(b) the period within which the person is to give the information; and

If the notice requires a person to appear before an officer, the notice must state a time and a place for the person to appear, and the time must be at least 14 days after the notice is given.

347(10) Offences  

A person must not, without reasonable excuse, intentionally or recklessly refuse or fail to comply with a requirement made under section 343, 344 or 345 to the extent that the person is capable of complying with it.

Penalty for a contravention of this subsection: Imprisonment for 12 months.

Note:

Subsection 4B(2) of the Crimes Act 1914 allows a court that convicts an individual of an offence to impose a fine instead of, or in addition to, a term of imprisonment. The maximum fine that a court can impose on the individual is worked out by multiplying the maximum term of imprisonment (in months) by 5, and then multiplying the resulting number by the amount of a penalty unit. The amount of a penalty unit is stated in section 4AA of that Act.
