SECTION 348   RELATIONSHIP WITH OTHER LAWS

Nothing contained in any law of a State or a Territory operates to prevent a person from:

(a)    giving information; or

(b)    producing documents; or

(c)    giving evidence;

that the person is required to give or produce to the Department or to an officer for the purposes of this Act (including the purposes of the administration of a current special educational assistance scheme).

This Division does not require a person to give information or produce a document to the extent that in doing so the person would contravene a law of the Commonwealth (other than a law of a Territory).

S 348 amended by No 149 of 2008, s 3 and Sch 1 item 25, by inserting " (including the purposes of the administration of the ABSTUDY scheme) " after " this Act " , effective 11 December 2008 and applicable in relation to a schooling requirement payment (within the meaning of the Social Security (Administration) Act 1999 as amended by No 149 of 2008) whether it is claimed, or granted, before, on or after 11 December 2008.
