PART 8.6 - FIDELITY FUNDS
SECTION 1249 POWER OF FUTURES ORGANISATION TO ENTER INTO CONTRACTS OF INSURANCE OR INDEMNITY 1249(1) [Fidelity insurance] A futures organisation may enter into a contract with a person carrying on fidelity insurance business whereby the futures organisation will be insured or indemnified, to the extent and in the manner provided by the contract, against liability in respect of claims under this Part. 1249(2) [Scope of insurance] Such a contract may be entered into in relation to contributing members of the futures organisation generally, or in relation to particular contributing members named in the contract, or in relation to contributing members generally with the exclusion of particular contributing members named in the contract. 1249(3) [Qualified privilege] A futures organisation, a member or employee of a futures organisation or of the board of a futures organisation, or a member of the management sub-committee of the board of a futures organisation, has qualified privilege in respect of the publication of a statement that a contract entered into under this section does, or does not, as the case may be, apply in relation to that member.
