24   Subsection 63(5)

Omit all the words after paragraph (d), substitute:

the following paragraphs have effect:

(e) if the person is receiving newstart allowance and is neither:

(i) subject to a requirement by the Secretary to participate in the PSP; nor

(ii) a party to a Newstart Activity Agreement under which the person is required to participate in the PSP;

the allowance is not payable and if, at a later time, newstart allowance becomes payable to the person, an administrative breach rate reduction period applies to the person;

(f) in any other case, the payment that the person has received or has claimed is not payable.
