Division 638 - Approved Forms  

SECTION 638-1   REGISTRAR MAY APPROVE FORMS  

638-1(1)    
The Registrar may, in writing, approve a form for any notice, statement, application or other document given to the Registrar, or any other person, for the purposes of a provision of this Act.

638-1(2)    
The approval may require all or any of the following:

(a)    the form in which the notice, statement, application or other document is to be given;

(b)    that the notice, statement, application or other document contain a declaration that is of the kind specified in the approval and that is signed by a person of the kind specified in the approval;

(c)    that the notice, statement, application or other document contain information that is of the kind specified in the approval;

(d)    subject to subsection (3) , the manner in which the notice, statement, application or other document is to be given.

638-1(3)    
This section, and any approval under this section, does not affect the operation of section 404-10 .

Note:

Section 404-10 deals with lodging documents with the Registrar electronically.


638-1(4)    
The Registrar may approve different forms for different entities.

638-1(5)    
The Registrar may combine in the same form more than one notice, statement, application or other document.

638-1(6)    
If the giving of a notice, statement, application or other document is covered by an approval under this section:

(a)    the notice is taken for the purposes of this Act not to have been given if it is not in accordance with that approval; and

(b)    is in the approved form if, and only if, it is in accordance with that approval.

However, strict compliance is not required and substantial compliance is sufficient.
