Schedule 3 Investigation of Commonwealth offences
Crimes Act 1914
6 Subsection 23B(1) (definition of under arrest )
Repeal the definition, substitute:
under arrest : a person is under arrest if:
(a) the person is arrested for a Commonwealth offence; and
(b) the person's arrest has not ceased under subsection (3) or (4); and
(c) the person has not been released.
