Division 160 - Objections  

SECTION 160-20   ENTITY MAY REQUIRE COMMISSIONER TO MAKE AN OBJECTION DECISION  

160-20(1)    
The entity may give the Commissioner a written notice requiring the Commissioner to make an objection decision, if:

(a)    the objection has been lodged with the Commissioner within the review period; and

(b)    the Commissioner has not made an objection decision by the later of:


(i) the end of the period (the original 60-day period ) of 60 days after the day (the objection day ) on which the objection is lodged with the Commissioner; and

(ii) if the Commissioner, by written notice served on the entity within the original 60-day period, requires the entity to give information relating to the objection - the end of the period of 60 days after the Commissioner receives that information.

160-20(2)    
Treat the reference in subparagraph (1)(b)(i) to the objection day as being a reference to the day on which the Commissioner decides under subsection 160-10(6) to agree to a request in relation to the objection, if the Commissioner does so after the objection day.

160-20(3)    
The Commissioner is taken, at the end of the period of 60 days after being given the notice under subsection (1) , to have made a decision under subsection 160-15(1) to disallow the objection, if the Commissioner has not made an objection decision by the end of that period.
