Repeal the item, substitute:

5 Amendments to legislative instruments

Subsection 12(2) (retrospective application of legislative instruments) of the Legislation Act 2003 does not apply to a legislative instrument (the amending instrument ) if:

(a) the amending instrument is made under an Act (the enabling Act ); and

(b) the amending instrument amends another legislative instrument made under the enabling Act; and

(c) the amendment is consequential on:

(i) the amendments or repeals made by this Act; or

(ii) the enactment of this Act or the PGPA Act.
