PART 10 - GENERAL PROVISIONS  

SECTION 104   SECRETARY MAY REQUIRE A PERSON TO PROVIDE INFORMATION ABOUT COMPLIANCE WITH THIS ACT  

104(1)    
The Secretary may, by written notice given to a person who the Secretary believes on reasonable grounds has information or documents relevant to determining whether this Act has been complied with, require the person to give the information or documents to the Secretary.

104(2)    
The information must be provided:


(a) in a form (if any) approved by the Secretary; and


(b) in accordance with other requirements specified by the Secretary.

104(3)    
A notice under this section must not require the giving of information by an approved course provider that the provider is required to give to the Secretary under any other provision of this Act.

104(4)    
A person contravenes this subsection if the person fails to provide information or documents in accordance with a requirement under subsection (1).

Civil penalty: 60 penalty units.


104(5)    
A person commits an offence of strict liability if the person fails to provide information or documents in accordance with a requirement under subsection (1).

Penalty: 60 penalty units.
