PART 7 - TRANSITIONAL MATTERS RELATING TO THE REPEAL OF THE EXCISE REGULATIONS 1925  

SECTION 59   APPLICATION OF THE EXCISE REGULATIONS 1925 TO PERMISSIONS UNDER THE ACT  

59(1)    
Despite the repeal of the Excise Regulations 1925 , those Regulations (the old regulations ) as in force immediately before they were repealed continue to apply in relation to a permission in force at that time under section 61C , 61D or 61E of the Act.

59(2)    
However, if the permission is amended after that time:


(a) the old regulations cease to apply in relation to the permission when the amendment takes effect (the amendment time ); and


(b) from the amendment time, this instrument applies in relation to the permission as if the permission had been given after the repeal of the old regulations.

59(3)    
If an application for a permission under section 61C , 61D or 61E of the Act had been made before the repeal of the old regulations, but no decision had been made on the application at the time of the repeal, this instrument applies in relation to the application as if the application had been made after the repeal.
