SECTION 39   REFERENCE OF QUESTIONS OF LAW TO FEDERAL COURT  

39(1)   [Reference by Tribunal or on party's request]  

The Tribunal may, on its own initiative or on the request of a party, refer a question of law arising in relation to a complaint to the Federal Court for decision.

39(2)   [Jurisdiction]  

The Federal Court has jurisdiction to hear and determine a question of law referred to it under this section.

39(3)   [Tribunal's actions]  

If a question of law in relation to a complaint has been so referred to the Federal Court, the Tribunal must not:


(a) make a determination to which the question is relevant while the reference is pending; or


(b) do anything that is inconsistent with the opinion of the Federal Court on the question.
