We are authorised by the Superannuation Industry (Supervision) Act 1993, Superannuation Industry (Supervision) Regulations 1994, Retirement Savings Accounts Act 1997 and Retirement Savings Accounts Regulations 1997 to ask for the information on this application form. We will use this information to determine your eligibility for early release of superannuation on compassionate grounds. If the information is not collected it could increase the chance of a delay or error in processing your application for a determination for early release of your super. Where authorised by law, we may also collect certain information indirectly, from third parties, such as other government departments and agencies, financial institutions and employers.

We are authorised by the Taxation Administration Act 1953 to request your tax file number (TFN). We will use your TFN to identify you in our records. It is not an offence not to provide your TFN but if you don’t there may be delays or administrative errors in processing your application form. In addition, if you do not provide your TFN you will be unable to use the ATO’s online services to lodge this form.

Certain information about your computer, your browser and the authentication process will also be logged by us when you authenticate online and use ATO Online services.

We may disclose the information collected on this form to your superannuation fund. Where authorised by law to do so, we may also give this information to other government departments and agencies, such as Services Australia, Department of Social Services and law enforcement agencies.

We also provide taxpayer information to treaty partners overseas under international tax agreements.

If you have an Australian Business Number, some information on this application form may be collected under the A New Tax System (Australian Business Number) Act 1999 and may be used to update your details on the Australian Business Register (ABR). Where authorised by law, selected information may be made publicly available and some may be passed to a wide range of government agencies, including Australian, state and local government agencies.
