Item 131 of Sch 3 of No 142 of 1999, effective 1 July 2000, contains the following transitional provision:
Agents licences continue as broker's licences
(1) An agents licence that was in force immediately before the commencement of this Schedule continues in force as a broker's licence as if it had been granted under the
Customs Act 1901
(as amended by this Schedule) immediately after the commencement of this Schedule.
(2) This item does not prevent:
(a)
the suspension or cancellation of such a licence; or
(b)
the alteration or endorsement of such a licence; or
(c)
the variation of an endorsement on such a licence.
SECTION 183B
INTERPRETATION
183B(1)
[Application under sec 183CA]
In this Division, unless the contrary intention appears, ``application'' means an application under section 183CA.
183B(2)
[Authority to act on behalf of owner]
For the purposes of this Division, a person shall be taken to participate in the work of a customs broker if
-
(a)
he or she has authority as a nominee of, or as an agent, officer or employee of, the customs broker, to do any act or thing for the purposes of the Customs Acts on behalf of an owner of goods; or
(b)
he or she has authority to direct a person who has authority referred to in paragraph (a) in the exercise of that authority.
