SECTION 105   COSTS OF APPEAL  

105(1)   [Official Trustee not personally liable]  

The Official Trustee is not personally liable for costs in relation to an application to review a decision made by the Official Trustee under subsection 102(1) , (3) or (4) in respect of a proof of debt.

105(2)   [Trustee ' s liability]  

A registered trustee is not personally liable for such costs unless the Court is of opinion that there are special circumstances that justify an order that the trustee be personally liable.
