Student Assistance Act 1973

S 356 substituted by No 79 of 2011, s 3 and Sch 4 item 14, effective 26 July 2011. No 79 of 2011, s 3 and Sch 4 item 15 contains the following transitional provisions:

15 Transitional - guidelines for exercise of Secretary ' s disclosure powers  
(1)
Guidelines in force under section 356 of the Student Assistance Act 1973 immediately before the commencement of this item continue in effect, after that commencement, as if they had been made under that section, as in force after that commencement.

(2)
Subitem (1) does not prevent the variation or revocation of the guidelines after that commencement.

S 356 formerly read:

SECTION 356 GUIDELINES FOR EXERCISE OF SECRETARY'S CERTIFICATE POWER  
356(1) Minister may set guidelines  

The Minister, by written determination:

(a) is to set guidelines for the exercise of Secretary's power to give certificates for the purposes of paragraph 355(1)(a) ; and

(b) is to set guidelines for the exercise of the Secretary's power under paragraph 355(1)(b) ; and

(c) may revoke or vary those guidelines.

356(2) Disallowable instrument  

A determination made under subsection (1) is a disallowable instrument.
