Subdivision A - Appointment of members  

SECTION 213   OATH OR AFFIRMATION OF OFFICE  

213(1)    
A person who is appointed or reappointed as a member or to act as a member must, before beginning to discharge the duties of the member ' s office, take an oath or affirmation.

213(2)    
The oath or affirmation is an oath or affirmation that the person will well and truly serve in the office, and do right to all manner of people according to law without fear or favour, affection or ill-will.

213(3)    
An oath or affirmation to be taken by the President must be taken before:

(a)    the Governor-General; or

(b)    a Justice of the High Court; or

(c)    a Judge of the Federal Court; or

(d)    a Judge of the Supreme Court of a State or a Territory.

213(4)    
An oath or affirmation to be taken by a member other than the President must be taken before:

(a)    the Governor-General; or

(b)    a Justice of the High Court; or

(c)    a Judge of the Federal Court; or

(d)    a Judge of the Supreme Court of a State or a Territory; or

(e)    the President.
