SECTION 58   RESOLVING DISAGREEMENTS BETWEEN TRIBUNAL MEMBERS

58(1)    
If 2 members constitute the Tribunal for the purposes of a proceeding and they do not agree about any matter, the view of the presiding member prevails.

3 members

58(2)    
If 3 members constitute the Tribunal for the purposes of a proceeding and they do not agree about any matter:

(a)    if the majority agree - the view of the majority prevails; or

(b)    in any other case - the view of the presiding member prevails.
