CHARGES FOR INFORMATION REQUESTED
2.05(1)
Subject to this regulation, the obligation of an RSA provider under these Regulations to give information on request by a person arises only if the person pays the amount specified by the RSA provider as the charge for giving the information.
2.05(2)
The amount of the charge must not exceed the reasonable cost to the RSA provider of giving the information (including all reasonably related costs
-
for example, costs of searching for, obtaining and collating the information).
2.05(3)
In the case of information to be supplied under Division
2.6
to a concerned person (as defined in subregulation
2.34(3)
), a charge may be made only if:
(a)
the person to whom the information is to be given has requested the information; and
(b)
the person had been given the same information during the period of 12 months immediately preceding the date on which the request is made.
