REGULATION 10.2.197   HAWKING INTEREST IN MANAGED INVESTMENT SCHEME  

10.2.197(1)   [ Application]  

For section 1444 of the Act, this regulation applies in relation to interests in managed investment schemes.

10.2.197(2)   [ If Pt 7.9 Div 2 applies]  

If Division 2 of Part 7.9 of the Act applies to an interest in a managed investment scheme:

(a) section 992AA of the Act applies to the interest; and

(b) section 736 of the old Corporations Act does not apply to the interest.

10.2.197(3)   [ If Pt 7.9 Div 2 does not apply]  

If Division 2 of Part 7.9 of the Act does not apply to an interest in a managed investment scheme, sections 992A and 992AA of the Act do not apply to the interest.
