REGULATION 10.2.23   STATUS OF NOTICE TO APPLICANT  

10.2.23(1)   [ Application]  

This regulation applies if:


(a) a futures exchange was required, before the FSR commencement, to give an applicant for membership of the futures exchange a notice under subsection 1135(1) of the old Corporations Act; and


(b) the futures exchange had not complied with the requirement before the FSR commencement; and


(c) the period for compliance had not expired before the FSR commencement.

10.2.23(2)   [ Appeal rights under old Corporations Act]  

On and after the FSR commencement, subsection 1135(1) of the old Corporations Act, as in force immediately before the FSR commencement, continues to have effect in relation to the futures exchange in its capacity as a market licensee.
