PART 4 - COMPLAINTS, PROCEDURAL MATTERS RELATING TO COMPLAINTS AND COMPLAINTS THE TRIBUNAL CANNOT DEAL WITH  

SECTION 20   TRIBUNAL NOT TO DEAL WITH COMPLAINT IF SUBJECT MATTER OF COMPLAINT IS SUBJECT OF COURT PROCEEDINGS  

20(1)   [Prior court proceedings]  

The Tribunal cannot deal with a complaint if a proceeding has been begun in a court about the subject matter of the complaint and the proceeding has not been finally disposed of.

20(2)   [Court proceedings begun after complaint]  

If, after a complaint has been made to the Tribunal, a proceeding is begun in a court about the subject matter of the complaint, the Tribunal cannot deal with the complaint until the proceeding is finally disposed of.
