MISLEADING CONDUCT BY RSA PROVIDERS

CIVIL LIABILITY
73(1)
This section applies if an RSA provider is dealing with:
(a)
a holder of an RSA as such a holder; or
(b)
an employer, or an associate of an employer, who makes an application, on behalf of an employee of the employer, for the employee to become the holder of an RSA, as such an employer.
73(2)
When so dealing with the holder of the RSA, the employer or the associate, the RSA provider must not engage in conduct that is:
(a)
misleading; or
(b)
likely to mislead.
73(3)
A contravention of subsection (2) is not an offence, but it may give rise to civil liability under section
74
.
