PART 13 - ADMINISTRATION OF ACT  

SECTION 115   SECRETARY MAY DELEGATE POWERS  

(1)    
The Secretary may, by signed writing, delegate to an SES employee in the Department all or any of the Secretary ' s powers under this Act.

(2)    
The Secretary may, by signed writing, delegate to the Chief Executive Officer of the Australian Customs Service the power to amend the ledger under paragraph 66(a) (when duty credit is applied by a person in respect of the importation of eligible imports) or paragraph 66(aa) (when duty credit is applied against previously paid duty).

(3)    
If the Secretary delegates a power mentioned in subsection (2) to the Chief Executive Officer of the Australian Customs Service, the Chief Executive Officer may, by writing, sub-delegate the power to an officer of Customs (within the meaning of the Customs Act 1901 ).

(4)    
Sections 34AA, 34AB and 34A of the Acts Interpretation Act 1901 apply in relation to the sub-delegation in a corresponding way to the way in which they apply to a delegation.
