General outline and financial impact statement

General outline

Item 45 of Schedule 1 would have repealed the definition of educational institution in subsection 23(1) of the Social Security Act 1991. The amendment retains and corrects the definition to ensure the ongoing administration and correct payment of youth allowance, austudy payment and fares allowance.

Notes on amendments

Amendment 1 - Schedule 1, item 45, page 15 (lines 17 to 20)

This amendment removes and remakes item 45 of Schedule 1. It corrects the reference to the Student and Youth Assistance Act 1973 in the definition of educational institution in subsection 23(1) of the Social Security Act 1991 and changes it to the Student Assistance Act 1973.

Item 45 as originally introduced sought to repeal the definition of "educational institution" in subsection 23(1) of the Social Security Act 1991. The repeal would have had considerable impact on the administration of youth allowance, austudy payment and fares allowance. The effect of this amendment is restore and amend the definition as was originally intended.
