Amendments to be Moved on Behalf of the Government

Outline

These government amendments to the Home Affairs Legislation Amendment (Miscellaneous Measures) Bill 2018 (the Bill) amend the commencement provisions in Clause 2 of the Bill.

Specifically, the government amendments provide that the whole of this Act will commence on the day after the end of the period of 12 months beginning on the day this Act receives the Royal Assent.

These amendments will have a no financial impact.

Amendment

Amendment 1 - Clause 2, page 1 (line 8) to page 2 (line 7)

1. This item amends the times at which the various provisions of the Act commence.

2. Item 1 amends subclause 2(1) of the Bill to provide that each provision of the Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3. Table item 1 provides that the whole of this Act will commence on the day after the end of the period of 12 months beginning on the day this Act receives the Royal Assent.

4. The note in subclause 2(1) makes it clear that the table relates only to the provisions of the Act as originally enacted. The table will not be amended to deal with any later amendments to the Act.

5. Subclause 2(2) of the Bill provides that any information in column 3 of the table is not part of the Act. Information may be inserted in this column, or information in it may be edited, in any published version of the Act. There is currently no information in column 3 of the table.
