Bankruptcy Act 1966

Div 2 heading substituted by No 11 of 2016, s 3 and Sch 1 item 51, applicable in relation to the administration of regulated debtors ' estates on and after 1 September 2017. The heading formerly read:

Division 2 - Remuneration and costs

S 163(1) amended by No 34 of 2006, s 3 and Sch 1 item 11, by substituting " determined by the Minister by legislative instrument " for " prescribed by the regulations " , applicable to remuneration of the Official Trustee for work arising from any of the following events happening on or after 1 July 2006:

(a) the making of a direction under section 50 of this Act;

(b) a person becoming bankrupt;

(c) lodgment of a proposal for a composition or scheme of arrangement under section 73 of this Act;

(d) the giving of a proposal for a debt agreement under section 185C of this Act;

(e) signature of an authority under section 188 of this Act;

(f) the making of an order for the Official Trustee to act as the trustee of an estate.

S 163(1) substituted by No 12 of 1980, s 83, amended by No 44 of 1996, Sch 1, Pt 1(298); No 11 of 1997, s 3 and Sch 1(11).

S 163(2) amended by No 34 of 2006, s 3 and Sch 1 item 12, by omitting " prescribed " before " remuneration may be in respect " , applicable to remuneration of the Official Trustee for work arising from any of the following events happening on or after 1 July 2006:

(a) the making of a direction under section 50 of this Act;

(b) a person becoming bankrupt;

(c) lodgment of a proposal for a composition or scheme of arrangement under section 73 of this Act;

(d) the giving of a proposal for a debt agreement under section 185C of this Act;

(e) signature of an authority under section 188 of this Act;

(f) the making of an order for the Official Trustee to act as the trustee of an estate.

S 163(2) amended by No 8 of 2005, s 3 and Sch 1 item 103, by substituting " to the Commonwealth " for " into the Consolidated Revenue Fund " , effective 22 February 2005. For savings provisions see note under s 20G.
