Part IIIB inserted by No 197 of 2012, s 3 and Sch 3 item 29, effective 12 March 2014. No 197 of 2012, s 3 and Sch 6 item 5 contains the following transitional provision:
5 Privacy codes may be developed etc. during the transition period
5(1)
A function or power conferred on the Commissioner or an entity by Part
IIIB
of the Privacy Act, as inserted by Schedule 3 to this Act, may be performed or exercised during the transition period as if the Privacy Act, as amended by this Act, was in force during that period.
5(2)
The performance of such a function, or the exercise of such a power, during the transition period has effect, after the commencement time, as if it had been performed or exercised under Part IIIB of the Privacy Act as inserted by Schedule 3 to this Act.

SECTION 26K
REMOVAL OF REGISTERED APP CODES
26K(1)
The Commissioner may remove a registered APP code from the Codes Register:
(a)
on his or her own initiative; or
(b)
on application by an APP entity that is bound by the code; or
(c)
on application by a body or association representing one or more APP entities that are bound by the code.
26K(2)
An application under paragraph (1)(b) or (c) must:
(a)
be made in the form and manner specified by the Commissioner; and
(b)
be accompanied by such information as is specified by the Commissioner.
26K(3)
Before deciding whether to remove the registered APP code, the Commissioner must:
(a)
consult any person the Commissioner considers appropriate about the proposed removal; and
(b)
consider the extent to which members of the public have been given an opportunity to comment on the proposed removal.
26K(4)
In deciding whether to remove the registered APP code, the Commissioner may consider the matters specified in any relevant guidelines made under section
26V
.
