SECTION 766B
APPLYING FOR CHANGE OF TYPE
766B(1)
Lodging application
To change its type, the Exchange must lodge an application with the Commission under the Corporations Law of the Capital Territory.

766B(2)
Contents of the application
The application must be accompanied by the following:
(a)
copy of the 18 October 1996 special resolutions dealing with the change of type;
(b)
a statement signed by the directors of the Exchange that in their opinion the Exchange's creditors are not likely to be materially prejudiced by the change of type and that sets out their reasons for that opinion;
(c)
the following information:
(i) the total number of shares to be issued upon the change of type;
(ii) the amount of capital to be applied in paying up each share;
(iii) the amount per share remaining unpaid;
(d)
a copy of proposed amendments of the constitution, business rules and listing rules of the Exchange;
(e)
a copy of the Minister's written approval of the proposed amendments.

[Non-application of certain provisions]
The following provisions do not apply to the proposed amendments referred to in paragraph
(2)(d):
(a)
section
774;
(b)
any requirement in the constitution, business rules or listing rules of the Exchange that would normally apply to the making of amendments of the constitution, business rules or listing rules.
