31 Application of amendments

(1)
The amendments made by this Part apply on and after the day on which the first authorisation of an external dispute resolution scheme, under Part
7.10A
of the
Corporations Act 2001
as amended by Part 1 of this Schedule, comes into force.
(2)
Without limiting subitem (1), the amendments made by items 13, 14 and 29 apply in relation to disclosures of information made on and after the day on which that authorisation comes into force, whether the information was acquired before, on or after that day.
AFCA may, on its own initiative or on the request of a party to a superannuation complaint, refer a question of law arising in relation to the making of a determination relating to the complaint to the Federal Court for decision.
1054C(2)
The Federal Court has jurisdiction to hear and determine a question of law referred to it under this section.
1054C(3)
If a question of law has been so referred to the Federal Court, AFCA must not:
(a) make the determination to which the question is relevant while the reference is pending; or
(b) do anything that is inconsistent with the opinion of the Federal Court on the question.
