PART 10.73 - APPLICATION PROVISIONS RELATING TO SCHEDULE 8 TO THE TREASURY LAWS AMENDMENT (SUPPORT FOR SMALL BUSINESS AND CHARITIES AND OTHER MEASURES) ACT 2024  

SECTION 1703   APPLICATION PROVISION  

1703(1)    
The amendments made by Part 1 of Schedule 8 to the Treasury Laws Amendment (Support for Small Business and Charities and Other Measures) Act 2024 apply in relation to a complaint made under the AFCA scheme, whether the complaint was made before, on or after the commencement of this section.

1703(2)    
To avoid doubt, a reference in subsection (1) of this section to a complaint made under the AFCA scheme includes a reference to a complaint that:

(a)    was purportedly made under the AFCA scheme before that commencement; and

(b)    was a complaint relating to superannuation but was not a superannuation complaint.

1703(3)    
Despite subsection (1) , the amendments do not affect the validity (or invalidity) of a determination, made or purportedly made by AFCA before that commencement, of a complaint made under the AFCA scheme.
