SECTION 36-40 Providers to cancel enrolments in certain circumstances
36-40(1)
A
higher education provider must cancel a person's enrolment in a unit of study
with the provider if the person:
(a)
is enrolled
as a *Commonwealth supported student in relation to the unit; and
(b)
has not, on or before the *census
date for the unit:
(i) completed, and signed, a *request for Commonwealth assistance in relation to the unit or, where the unit forms part of a *course of study undertaken with the provider, in relation to the course of study; and
(ii) given it to an *appropriate officer of the provider.
36-40(2)
A
higher education provider must cancel a person's enrolment in a unit of study
with the provider if the person:
(a)
is enrolled
as a *Commonwealth supported student in relation to the unit; and
(b)
is not entitled to *HECS-HELP assistance
for the unit; and
(c)
has
not, on or before the *census date for the unit, paid to the provider the
whole of the person's *student contribution amount for the unit.
However, this subsection does not apply if the person's student contribution amount for the unit is a nil amount.
36-40(3)
A request for Commonwealth assistance , in relation to a person enrolling in a unit of study with a higher education provider (where access to the unit was not provided by *Open Universities Australia), means a document:
(a)
in which the person
requests the Commonwealth to provide assistance under this Act in relation
to the unit or, where the unit forms part of a *course of study undertaken
with the provider, in relation to the course of study; and
(b)
that is in the form approved by the
Minister.
