SECTION 116   OFFENCE - FAILURE TO COMPLY WITH SUMMONS  

116(1)    
A person commits an offence if:

(a)    the person is given a summons under section 74 ; and

(b)    the person fails to comply with the summons.

Penalty: Imprisonment for 6 months or 30 penalty units, or both.


116(2)    
Subsection (1) does not apply if it is not reasonably practicable for the person to comply with the summons by the time specified in the summons or within such further period as the Tribunal allows.

Note:

A defendant bears an evidential burden in relation to the matter in this subsection (see subsection 13.3(3) of the Criminal Code ).
