SECTION 39   GENERAL RULES FOR CONSTITUTION OF TRIBUNAL  
General rules

39(1)    
The Tribunal must be constituted for the purposes of a proceeding by a single member, 2 members or 3 members.

39(2)    
The Tribunal may be constituted by 2 or 3 members only if the President considers that it is appropriate to do so:

(a)    because the proceeding raises a complex issue; or

(b)    because one or more of the members have particular expertise relevant to the proceeding; or

(c)    in the interests of justice.

39(3)    
The Tribunal constituted must have no more than one member who is a Judge.

Exceptions

39(4)    
This section is subject to Subdivision C (guidance and appeals panel).
