Student Assistance Act 1973

S 345 substituted by No 26 of 2018, s 3 and Sch 17 item 70, applicable in relation to requirements made on or after 1 July 2018. S 345 formerly read:

SECTION 345 POWER TO OBTAIN INFORMATION ABOUT A PERSON WHO OWES A DEBT TO THE COMMONWEALTH  
345(1) Secretary may require information etc. concerning debts under Act  

If the Secretary believes that a person may have information or a document:

(a) that would help the Department locate another person who owes a debt to the Commonwealth under this Act in relation to a student assistance benefit; or

(b) that is relevant to the financial situation of a person referred to in paragraph (a);

the Secretary may require the first-mentioned person to give the information, or produce the document, to the Department.

Note:

A requirement under this section may be sent to a company as well as to a natural person - subsection 2C(1) of the Acts Interpretation Act 1901 provides that person includes a body corporate.
