PRIVACY CODES
History
Part IIIB inserted by No 197 of 2012, s 3 and Sch 3 item 29, effective 12 March 2014. No 197 of 2012, s 3 and Sch 6 item 5 contains the following transitional provision:
5 Privacy codes may be developed etc. during the transition period
5(1)
A function or power conferred on the Commissioner or an entity by Part
IIIB
of the Privacy Act, as inserted by Schedule 3 to this Act, may be performed or exercised during the transition period as if the Privacy Act, as amended by this Act, was in force during that period.
5(2)
The performance of such a function, or the exercise of such a power, during the transition period has effect, after the commencement time, as if it had been performed or exercised under Part IIIB of the Privacy Act as inserted by Schedule 3 to this Act.

SECTION 26P
DEVELOPMENT OF CR CODE BY CR CODE DEVELOPERS
26P(1)
The Commissioner may, in writing, request a CR code developer to develop a CR code and apply to the Commissioner for the code to be registered.
26P(2)
The request must:
(a)
specify the period within which the request must be complied with; and
(b)
set out the effect of section
26L
.
26P(3)
The period:
(a)
must run for at least 120 days from the date the request is made; and
(b)
may be extended by the Commissioner.
26P(4)
The request may:
(a)
specify one or more matters that the CR code must deal with; and
(b)
specify the credit providers, or a class of credit providers, that should be bound by the code; and
(c)
specify the other entities, or a class of other entities, subject to Part
IIIA
that should be bound by the code.
26P(5)
The Commissioner must make a copy of the request publicly available as soon as practicable after the request is made.
