REGULATION 10.2.114   SUFFICIENT TRANSFER BY AUTHORISED TRUSTEE CORPORATION  

10.2.114(1)   [ Application]  

This regulation applies if the arrangements for the completion of a document, to make the document:


(a) a sufficient transfer of marketable securities by an authorised trustee corporation under subsection 1102(1) of the old Corporations Act; or


(b) a sufficient transfer of marketable rights by an authorised trustee corporation under subsection 1102(2) of the old Corporations Act;

were not completed before the FSR commencement.

10.2.114(2)   [ Continued application of previous provisions]  

Section 1102 of the old Corporations Act, and any associated provisions, continue to apply to the extent necessary to allow for the document to be duly completed, and treated as a sufficient transfer by an authorised trustee corporation, in accordance with the relevant arrangements.

10.2.114(3)   [ Document duly completed]  

If the document is duly completed in accordance with the relevant arrangements, the document is also taken to be a sufficient transfer by an authorised trustee corporation for the purposes of the Act as in force after the FSR commencement.
