Draft practical compliance guideline

PCG 2025/D1 Fees for personal financial advice paid from member accounts by superannuation funds – apportioning the deduction and pay as you go withholding obligations

This draft Practical Compliance Guideline sets out a methodology superannuation funds (other than self-managed superannuation funds (SMSFs)) can use to determine the extent to which payments of financial advice fees satisfy paragraph (d) of table item 5 of subsection?295-490(1) of the Income Tax Assessment Act 1997. It also outlines our compliance approach in relation to a superannuation fund's obligation to withhold from payments for personal financial advice fees in the income years prior to 1 July 2019, including SMSFs.

Synthesised text of the MLI and Australian tax treaty

Synthesised text of the MLI and the Agreement between Australia and Papua New Guinea

The Multilateral Convention to Implement Tax Treaty Related Measures to Prevent Base Erosion and Profit Shifting (the MLI) entered into force for Australia on 1 January 2019. The ATO is preparing a synthesised text for each of Australia's tax treaties that are modified by the MLI. A synthesised text helps users of the tax treaty understand how the MLI modifies the particular tax treaty. It does not constitute a source of law. The authentic legal texts of the tax treaty and the MLI take precedence and remain the legal texts applicable. The synthesised text to be published in this instance is that of Australia's tax agreement with Papua New Guinea.
