An application may be made to the Tribunal for review of a decision of the Treasurer under section 79A that a national security risk exists in relation to an action.
130A(2)
The application may be made by, or on behalf of, a person who has been given a notice by the Treasurer under subsection 79B(1) that such a national security risk exists.
130A(3)
At any time after the Tribunal has given its findings in relation to the review to the applicant, the applicant may apply for a review of the Tribunal ' s findings on the ground that the applicant has fresh evidence of material significance that was not available at the time of the previous review.

Subsection (2) applies despite section 17 of the ART Act.
